1. About these Terms

These Terms of Service ("Terms") govern your access to and use of Torifon — our website, the booking pages at torifon.com/[slug], the web and mobile applications for professionals, and the "Tori" voice receptionist and related features (together, the "Service").

By creating an account, clicking "I agree", booking through a Torifon booking page, or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

If you accept these Terms on behalf of a business, you represent that you are authorised to bind that business, and "you" means that business.

2. Definitions

  • Professional — a solo professional or business that creates a Torifon account to manage bookings, a public booking page, staff, and (where enabled) the Tori voice receptionist.
  • Client — an end customer who discovers a Professional, books an appointment, calls the Professional's number, or otherwise interacts with a Professional through the Service. A Client may use the Service with or without creating an account.
  • Content — anything submitted to or generated through the Service, including business details, photos, service menus, client records and notes, reviews, messages, call recordings and transcripts.
  • Tori — the AI voice receptionist that, where enabled by a Professional, answers calls, checks availability, and books appointments on the Professional's behalf.

3. Eligibility

You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract. The Service is not directed to children. Professionals must operate a lawful business and hold any licences their profession requires.

4. The Service — what Torifon is and is not

Torifon is a software platform that helps Professionals receive and manage appointments and helps Clients find and book them. It has three pillars: (a) the Tori AI voice receptionist; (b) a public booking page for each Professional; and (c) web/mobile apps for the Professional.

Torifon is a facilitator, not a party to the appointment. Any appointment, service, price, cancellation policy, and the quality of the service itself are solely between the Professional and the Client. We do not provide the underlying professional services, do not employ Professionals, and do not guarantee any booking, attendance, payment, or outcome. Each Professional is responsible for their own conduct, legal and tax compliance, and relationship with their Clients.

5. Accounts and security

You must provide accurate information and keep it up to date. You are responsible for activity under your account and for keeping your credentials and devices secure. We use third-party sign-in (e.g. Google and Apple) and email magic-links; you are responsible for the security of the email account and identity providers you use. Tell us promptly at [email protected] if you suspect unauthorised use.

6. Professional obligations

If you are a Professional, you additionally agree that you will:

  1. provide accurate business information, hours, services and prices, and honour bookings made through the Service in good faith;
  2. be the data controller of your own Client records and use Torifon as your processor for them — including obtaining any consent the law requires from your Clients (see §7 and the Privacy Policy), and responding to your Clients' privacy requests;
  3. before enabling call recording or the Tori voice receptionist, ensure your Clients are lawfully informed and, where required (including under Israeli wiretapping law and GDPR), have consented to the recording and processing of their calls — Torifon provides configuration tools (e.g. an announcement at the start of a call) but you remain responsible for lawful use;
  4. comply with all laws applicable to your business, including consumer-protection, advertising, professional-licensing, anti-discrimination, and tax law (note that VAT/Maam on your subscription is handled by the app store (Apple / Google) as merchant of record per §8, but VAT and reporting on the services you sell to your Clients are your responsibility);
  5. set and clearly communicate your own cancellation, no-show, and refund policies to your Clients; and
  6. not use the Service to send unlawful, deceptive, or unsolicited communications.

7. Clients, bookings and recordings

When a Client books through the Service, the resulting appointment is a contract between the Client and the Professional. Cancellations, rescheduling, no-shows, deposits and refunds are governed by the Professional's policy, not by Torifon.

Where a Professional enables call handling or recording, calls may be recorded, transcribed, and stored to provide the Service (see the Privacy Policy for retention). Clients are informed and, where required, asked to consent; a Client who does not consent should not proceed with the recorded interaction.

8. Fees, subscriptions and billing

Some features require a paid subscription. Current plans and prices are shown in the app.

  • In-app purchase only. Subscriptions are sold exclusively through the Apple App Store (on iOS) and Google Play (on Android) using their In-App Purchase systems. The applicable app store is the merchant of record for these purchases and collects and remits any applicable taxes (including Israeli VAT / Maam). We do not process card payments for subscriptions ourselves.
  • Billing cycle & renewal. Subscriptions are billed in advance through your Apple App Store or Google Play account on a recurring basis (e.g. monthly) and renew automatically until cancelled, in accordance with that store's terms.
  • Cancellation. You can manage or cancel your subscription at any time from your Apple App Store or Google Play account settings; cancellation stops future renewals and takes effect at the end of the current paid period.
  • Plan limits. Plans may include usage caps (e.g. number of voice minutes, messages, services, or bookings). We may rate-limit or require an upgrade when caps are exceeded.
  • Refunds. Refunds are handled by the applicable app store (Apple or Google) under their respective policies. Statutory consumer-cancellation rights (including under Israeli consumer law) are unaffected.
  • Changes. We may change plans and prices prospectively; we will give reasonable notice and price changes apply from your next renewal, subject to the app store's rules.

9. Acceptable use

You agree not to: break the law or infringe others' rights; upload content that is unlawful, defamatory, infringing, or that you have no right to share; misrepresent your identity or business; interfere with, overload, reverse-engineer, scrape, or attempt to gain unauthorised access to the Service; use the Service to harass, spam, or defraud; or use Torifon to build a competing service. We may suspend or terminate accounts that violate these Terms or that create legal or security risk.

10. The Tori voice receptionist (AI)

Tori is off by default; a Professional turns it on for their business. This section governs its use where enabled. When enabled, Tori is powered by third-party speech and large-language-model providers (see the Privacy Policy sub-processor list).

Where enabled, Tori uses automated speech and large-language-model technology to handle calls and bookings. Tori is an automated assistant and can make mistakes (e.g. mis-hearing, mis-booking, or misunderstanding a request). It is not a substitute for human judgement and must not be relied on for emergencies or for advice your profession is legally required to give. The Professional remains responsible for the bookings and communications made on their behalf. We are not liable for errors in AI-generated output beyond what §13–14 allow.

11. Your content and licence to us

You keep ownership of your Content. You grant Torifon a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (e.g. format/translate), and display your Content only as needed to operate and provide the Service — for example, showing a Professional's photos and service menu on their public booking page, or displaying a Client's review. You are responsible for having the rights to the Content you submit (including photos and any personal data of third parties).

12. Intellectual property

The Service, including its software, design, "Torifon" and "Tori" names and logos, and all related IP, belongs to Torifon or its licensors. These Terms grant you a limited, revocable, non-transferable right to use the Service; they do not transfer any IP to you.

13. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or secure, that bookings or AI output will be accurate, or that Clients will attend or pay. Third-party services (e.g. sign-in, maps, messaging, payments) are governed by their own terms and are outside our control.

14. Limitation of liability

To the fullest extent permitted by law: Torifon will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, goodwill, or business, arising out of or relating to the Service or these Terms. Our total aggregate liability for all claims relating to the Service will not exceed the amounts you paid us in the three (3) months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded by law (e.g. for fraud, or for death/personal injury caused by negligence).

15. Indemnity

You agree to indemnify and hold Torifon harmless from claims, damages, and reasonable costs (including legal fees) arising from your use of the Service, your Content, your breach of these Terms, or — for Professionals — your relationship with your Clients and your compliance obligations (including obtaining recording/processing consents and your own tax compliance).

16. Suspension, termination and effect of deletion

You may stop using the Service at any time. Professionals may delete their business from the app.

Deleting a business is permanent and irreversible. It cancels the associated subscription and hard-deletes the business and all associated data — including services, bookings, staff, client records, reviews, favourites, and (where applicable) call recordings and transcripts — via cascading deletion. There is no recovery once deleted; export anything you need first (see the Privacy Policy). We may suspend or terminate your access if you breach these Terms, create risk, or as required by law.

17. Changes to the Service and these Terms

We may modify the Service and these Terms. If we make material changes to the Terms, we will provide reasonable notice (e.g. in-app or by email). Changes take effect on the stated date; continuing to use the Service after that means you accept the updated Terms. If you do not agree, stop using the Service.

18. Governing law and jurisdiction

These Terms are governed by the laws of the State of Israel, without regard to conflict-of-laws rules. The competent courts of Tel Aviv-Yafo, Israel have exclusive jurisdiction, except that we may seek injunctive relief in any competent court. Mandatory consumer-protection rights in your country of residence are unaffected.

19. General

If any provision is unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms without our consent; we may assign them to an affiliate or successor. These Terms (with the Privacy Policy) are the entire agreement between you and Torifon regarding the Service.
